IAPD Privacy Policy

The International Association of Plastics Distribution (“IAPD”, “we” or “us”) is committed to ensuring that your privacy is protected. This Privacy Policy (“Policy”) applies to the IAPD owned and operated website https://iapd.org and its subdomains (collectively, the “Site”) and describes the information that we gather on or through the Site, how we use and disclose such information, how you can control the collection, correction and/or deletion of information and the steps we take to protect such information. This Policy does not apply to information we collect by other means (including offline) or from other sources. By visiting the Site you accept the privacy practices described in this Policy.

This Policy is incorporated into, and is subject to, the IAPD Terms of Service. Capitalized terms used but not defined in this Policy have the meaning given to them in the IAPD Terms of Service.

Definitions

“Member” means a member of IAPD.

“Personally Identifiable Information” means any information relating to an identified or identifiable natural person.

“User” means an employee, agent, or representative of a Member, who primarily uses the Members’ Only area of the Site.

“Visitor” means an individual other than a User, who uses the public area, but has no access to the Members’ Only areas of the Site.

1. What We Collect

User-provided Information: We may collect Personally Identifiable Information about you, such as your full name, job title, phone number, mailing address, email address, credit card or other billing information and demographic information such as preferences and interest or similar. You may provide us with personally identifiable information in various ways. For example, when your company applies for membership, when you register for an event or when you complete a survey. If you choose to purchase a product from us, we or our third-party payment processors will collect your payment information. 

Cookies and Online Tracking Technologies: As you navigate the Site, we may use automatic data collection technologies such as cookies or web beacons to collect certain information about your equipment, browsing actions, and patterns. A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyze Site traffic or lets you know when you visit a particular site. Cookies allow Site applications to respond to you as an individual. The Site application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our Site in order to tailor it to customer needs. We only use this information for statistical analysis purposes.

Overall, cookies help us provide you with a better Site by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the Site. This Site does not respond to do not track signals.

Access and Retention of Data Controlled by our Members: An individual who is a current or former member who seeks access or wishes to correct, amend or delete inaccurate data should direct their query to [email protected]

We will retain personal data we process on behalf of our members for as long as needed to provide our services and in accordance with our data retention policies. IAPD will retain this personal information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

2. What We Do With The Information We Collect


We use the information that we collect based on your consent, to provide the contractual products and services on the Site, and for our legitimate interest of operating and maintaining the Site and responding to your questions and concerns.

If you have provided your consent, we use the information that we collect to send you marketing communications in our newsletter. 

Email Usage: We use technologies to collect information regarding a User’s interaction with email messages, such as whether the User opens or clicks on a message. This information is gathered from all Users for our legitimate interest of ensuring receipt of messages and assessing the level of User interaction with the email.

Google Analytics: We use Google Analytics for our legitimate interest of measuring and evaluating access to and traffic on the Site and create user navigation reports for our Site administrators. 

We take measures to protect the technical information collected by our use of Google Analytics. The data collected will only be used on a need to know basis to resolve technical issues, administer the Site and identify visitor preferences; but in this case, the data will be in non-identifiable form. We do not use any of this information to identify Users.

3. How We Share The Information We Collect


Personally Identifiable Information: We will not sell or lease your personally identifiable information to third parties unless we have your permission or are required by law. We may, however, provide your personal information to sponsors or exhibitors of programs for which you have registered. We also may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen. In the event that we undergo a business transition, such as a merger, acquisition or sale of all or a part of our assets, your personal information will likely be among the assets transferred. We may disclose and/or transfer your information as an asset in connection with a proposed or actual merger or sale and any related due diligence of a potential buyer (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business as part of a corporate reorganization, stock sale, the sale of substantially all of our assets, or other change in control.

We may share your personal information with our third party service providers to enable IADP to provide this Site, products, and services to our Users.  

Non Personally Identifiable Information: We may make certain automatically-collected, aggregated, or otherwise non-personally-identifiable information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our Members’, Users’ and Visitors’ interests, habits and usage patterns for certain programs, content, services and/or functionality available through the Service.

Law Enforcement, Legal Process and Compliance: We may disclose Personally Identifiable Information or other information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws, in response to a facially valid court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

We also reserve the right to disclose Personally Identifiable Information or other information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Site and any facilities or equipment used to make the Site available, or (v) protect our property or other legal rights, enforce our contracts, or protect the rights, property, or safety of others.

Change of Ownership: Information about Members, including Personally Identifiable Information, may be disclosed and otherwise transferred to an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets or similar transaction, as well as in the event of an insolvency, bankruptcy or receivership in which information is transferred to one or more third parties as one of our business assets and only if the recipient of the User or Visitor Data commits to a Privacy Policy that has terms substantially consistent with this Policy.

4. Storage and Processing. 


Your information collected through IAPD is stored and processed in the United States. IAPD may transfer information that we collect about you, including personal information, to third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. 

5. Your Choices

Account Information: You can review, correct, update or delete inaccuracies to the information about you that IAPD keeps on file by logging into your account to update your password and billing information. Data protection law gives you a range of rights in connection with our processing of your personal data. In this regard, you have the right to request that we rectify or delete the personal data or restrict the processing of your personal data, if you think they are inaccurate. You also have the right to data portability so that you may obtain the data IAPD collects concerning you and reuse it for your own purpose. You may also withdraw your consent for IAPD to process your personal information by sending an email to [email protected]

If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact IAPD’s Data Protection Officer at [email protected]. You also have a right to lodge a complaint with data protection authorities.

You may decline to share certain Personally Identifiable Information with us, in which case we may not be able to provide to you some of the features and functionality of the Service.

Marketing Emails: If you receive marketing emails from us, you may unsubscribe at any time by following the instructions contained within the email. Please be aware that if you opt-out of receiving marketing emails from us it may take up to ten (10) business days for us to process your request. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding your membership.

6. Third Party Services

The Site may contain features or links to web sites and services provided by third parties including the Learning Management System and Application Software. 

Please remember that when you use a link to go from the IAPD Site to another website or service, our Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

Our Site includes social media features such as Facebook and Twitter. These features may collect your IP address and which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are hosted by a third party. Your interactions with these features are governed by the privacy policy of the organization providing it.

7. Children’s Privacy


IAPD’s Site is not directed to children under the age of 18 and we do not knowingly collect Personally Identifiable Information from children under the age of 18 without obtaining parental consent. If we learn that Personal Data has been collected on the Service from persons under 18 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information.

8. Security 


We are committed to ensuring that your information is secure. To help prevent unauthorized access or disclosure of personal information we have put in place reasonable physical, electronic and managerial procedures to safeguard and secure the information we collect online. However, we cannot ensure or warrant the security of any information you transmit to IAPD or guarantee that your information on the IAPD Site may not be accessed, disclosed, altered or destroyed by breach of any of our industry standard physical, technical or managerial safeguards. When you enter sensitive information (such as login credentials) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). No method of transmission over the Internet or method of electronic storage is 100 percent secure, however. Therefore, we cannot guarantee its absolute security. We use an outside credit card processing company to bill you if you purchase services. These companies are not permitted to retain, share, store or use personally identifiable information for any other purposes. 

If we learn of a security systems breach, we will inform you and the authorities of the occurrence of the breach in accordance with applicable law.

9. Changes To This Policy


Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. All changes to this Policy are effective when they are posted on this page. When we change the Policy in a material manner, we will let you know via email and/or a prominent notice on our Site, prior to the change becoming effective and update the ‘effective date’ at the top of this page.

  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's calendar, camera, contacts, storage. and other features. If you wish to change our access or permissions, you may do so in your devices settings.
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may tum them off in your devices settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes. 
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected. We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information. such as your device characteristics, operating system, device name, device model and other technical information. This information is primarily needed for our internal analytics and reporting purposes. 

Like many businesses. we also collect information through cookies and similar technologies.

  • Device Data. We collect device data such as information about your phone. tablet you use to access the Services. Depending on the device used, this device data may include information such as your application identification numbers and system configuration information.

5. HOW LONG DO WE KEEP YOUR INFORMATION? 


We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice unless a longer retention period is required. 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example. because your personal information has been stored in backup archives) then we will securely store your personal information and isolate it from any further processing until deletion is possible. 

6. HOW DO WE KEEP YOUR INFORMATION SAFE? 


We aim to protect your personal information through a system of organizational and technical security measures. We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. 7. DO WE COLLECT INFORMATION FROM MINORS? 


We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we deem that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.
